Trust Deed eligibility

Do I qualify for a
Protected Trust Deed?

Eligibility is about more than simply owing £5,000. Affordability, assets and whether a Trust Deed is appropriate all matter.

✓ Total debt must be at least £5,000✓ You must be insolvent✓ A trustee must assess affordability and suitability

The basic starting points

A Trust Deed can only be granted where total debts are at least £5,000. That does not mean everyone with £5,000 or more should enter one.

A licensed insolvency practitioner must consider the full financial position, including income, reasonable household expenditure, assets and alternative debt solutions.

Income & expenditure

Your contribution is based on a formal affordability assessment.

Assets

Property, vehicles and other assets can affect how a Trust Deed works.

Alternatives

DAS, sequestration or another route may be more appropriate depending on your circumstances.

Common questions

Questions people ask before taking the next step

Do I need to be employed?

Not necessarily. The key issue is your overall financial position and whether the arrangement can be administered appropriately.

What if I owe less than £5,000?

A Trust Deed cannot be granted below the statutory £5,000 debt threshold, but other debt solutions may be available.

Can I apply if I own my home?

Potentially, but home equity needs careful consideration and may influence whether another solution is more suitable.
